"The Problem is that they (prosecution) may have already lost the room. The Dept of Justice has spent years of credible allegations of bias, political influence in their investigations... (the long public indictment) is an effort to get the public to see that this is not political. Having said that, it is a devastating indictment. It has a great number of witnesses that are quoted ... coming from statements under oath... this audio tape that you just referred to is itself rather breathtaking. It contradicts what the President has previously said. And so the question is whether the President is better running against this case than defending against it. `Cause if he waves a speedy trial he could put this trial on the other side of the election and by then he could be President and pardon himself."

You might be in for a rude awakening. Jonathon Turley has made a LOT of comments about the way Trump and others have been improperly treated based on the law. If he is suggesting Trump needs to be concerned ... you better believe it.

That’s possible, but you won’t find too many legal types that have been fairer to Trump than Turley. He calls a spade a spade. Doesn’t make him correct here, but if you’re not a very knowledgeable expert in constitutional law you probably shouldn’t be dismissive of his opinions.

Personally, I think that the better-reasoned analysis is that a POTUS cannot pardon himself, but it is not remotely a slam-dunk either way.

Trumps best defense is to attack this case at its roots. The statute at the heart of this entire ordeal is not a criminal statute. Furthermore there is already precedence in regards to former presidents and documents. This case boils down to a document dispute and it should have been resolved through that avenue. What we have instead is the DoJ completely bypassing that’s entire avenue to resolve the issue and instead making a criminal case out of it. Furthermore, you have sworn testimony from high ranking a FBI agent to congress that essentially boils down to him raising his concerns about this tract and his questioning of whether or not there is a better way to resolve the issue at hand.
As we’ve seen over and over with various attempts to get Trump, there is always this massive overreach to launch an investigation under very dubious pretexts that eventually get exposed and fall apart. If I were his defense attorney, you bet your arse that I’d hammer the hell out of the fact that these very agencies that have brought these chargers against Trump have a very long and documented history of launching unfounded investigations against him. You attack their credibility and you don’t let up. You show the pattern of misconduct that started with the phony Russian collusion hoax has continued to this very indictment that turns a document dispute into an act of espionage.

Why is it still going on three years later? If trump was serious about returning the documents, why wasn’t it done?
