Yeah, he said not even in this instance, but once they get through this debt increase that he will set in motion the legal tests to see if it would hold for the future.

Democrats think the 14th Amendment gives the President the power to override the power of the purse reserved for the Congress.
It’s a creative argument. It essentially argues Congress passed and authorized this debt therefore the President has the power to enforce compliance and payment of said debt by unilaterally enacting funding, essentially legislation from the Executive branch under the fiction of paying past obligations.
This would be extremely problematic regarding separation of powers, the function of our system of government, and would exponentially increase the power of the President.
I think it is indicative of how our government is continuing to fracture as a functioning system under extreme political duress.

It’s not a creative argument; it’s an absurd argument. The provision in the XIV amendment is specifically addressing debts incurred by the Confederate States and by former slave owners by making such debts null and void.

We’ve basically got a lawless and rogue president at this point who openly defies our constitution and the legislative branch. If Biden invokes the XIV and orders the secretary of the treasury to pay debts of the nation without a congressional appropriation, then the Republicans in the House have to begin impeachment proceedings. That’s a clear cut violation of Biden’s oath of office and grounds for removal.
