Yeah, he said not even in this instance, but once they get through this debt increase that he will set in motion the legal tests to see if it would hold for the future.

Democrats think the 14th Amendment gives the President the power to override the power of the purse reserved for the Congress.

It’s a creative argument. It essentially argues Congress passed and authorized this debt therefore the President has the power to enforce compliance and payment of said debt by unilaterally enacting funding, essentially legislation from the Executive branch under the fiction of paying past obligations.

This would be extremely problematic regarding separation of powers, the function of our system of government, and would exponentially increase the power of the President.

I think it is indicative of how our government is continuing to fracture as a functioning system under extreme political duress.

It’s the reason why gun rights were right behind free speech in terms of importance of the founding fathers.

President Biden on Tuesday said he has been looking at the 14th Amendment as a way to unilaterally work around the debt ceiling, though he acknowledged it will not be a viable short-term solution with the nation on track to default without congressional action by June.

“I have been considering the 14th Amendment, and the man I have enormous respect for, Larry Tribe … thinks that it would be legitimate,” Biden told reporters after a meeting with congressional leaders on the debt ceiling.
Marxist lawfare blogger Lawrence Tribe. YCMTSUIYT! Someone stop the merry go round and let me off.

quote:

“But the problem is it would have to be litigated,” Biden continued. “And in the meantime, without an extension, it would still end up in the same place.”
Ya think? Bunch of downright card-carrying filthy communists.

I believe in and support the 14th Amendment. I think everyone should have the right to speak their mind.

Larry Lawrence Tribe is James Comey's BFF and is beyond a marxist hack; he is downright so full of hate he is evil.

He is gunning after Clarence Thomas. He only goes after non democrat, non-establishment. He should not be lauded nor revered, he is a hack.

Read the comments of them saying Papa is guilty.

They make Putin and Xi blush. Tribe & Comey should be in Sing Sing for seditious conspiracy.

It’s not a creative argument; it’s an absurd argument. The provision in the XIV amendment is specifically addressing debts incurred by the Confederate States and by former slave owners by making such debts null and void.

Updated to add the provision in question so folks can read it and judge for themselves:

quote:

Section 4. The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any state shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.

They’re ignoring section 5 of that amendment, good luck with that

That doesn’t mean what it clearly says, yet the right to privacy is in a penumbra and enumeration somewhere.

We’ve basically got a lawless and rogue president at this point who openly defies our constitution and the legislative branch. If Biden invokes the XIV and orders the secretary of the treasury to pay debts of the nation without a congressional appropriation, then the Republicans in the House have to begin impeachment proceedings. That’s a clear cut violation of Biden’s oath of office and grounds for removal.

That goes beyond impeachment. That goes to the point where it can be declared a coup by the White House.
