Fined for Illegal Parking by Private Company

We stayed in downtown Tulsa this past weekend. The hotel said we could park in a certain area facing the street. I drove to that lot and the only space open facing the street was a handicap space. No problem, my wife is disabled and we have a handicap tag on the vehicle.

When I went to get the car Sunday moring there was a note on the windshield saying I parked in an unauthorized space and that I had to pay a $125 fine ($35 if paid promptly!)

I raised heck with the hotel staff and they agreed to waive their parking charge of $25, but could not get the parking company to waive their fine.

I'm not going to pay that "fine", but wonder if the parking company has any recourse.

I don't understand your issue. You got a fine for parking in a handicap spot but if it wasn't handicap you would have been ok?

They are idiots for giving someone with a handicap tag parked in a handicap spot a ticket fwiw.

If you never deal with the parking company ever again, don't pay them. I doubt they would care to send that small amount of money to collections, and if they do, it's more of a burden on them.

If it was a ticket issued by police, you may not be able to park in a handicap spot on "private property" but I do not know the law. I would raise hell with whoever runs the property you were staying on, and keep going up the ladder until you get resolution, if you care to do so.

Their recourse is to take you to small claims court and they will never do that.

Toss it.

This happened to me at a Baton Rouge Hotel a couple of years ago. They waived the parking fee and gave us like 25k rewards points.

Let me clarify. About 20 spaces were for hotel parking. The 21st space was a handicap space, but I assumed it was part of the hotel's spaces. The parking lot company says it was not allocated to the hotel.

Will you be returning to the area in the next 5-10 years? If not, toss it. Only problem you can run into is if you get caught by that company again - they'll tow you instead of giving a ticket.

It’s probably a parking lot scam.

That video above says you should demand to see a written contact and/or call 911.

A private company ticketed you? Unless you agreed to terms before you parked, frick them. Maybe there was a sign like the kind in lots that can put a boot on your car.

If you got a boot from a private lot, they can claim you have to pay to remove the boot because that's what the "agreement" was via the signs in the lot. What happens if you can physically take the boot off and drive away...nothing. It's a private company, not a law enforcement division.

As mentioned, their only recourse is to take you to small claims court. Even if they did, you just make them prove you parked illegally. Did they take pictures? Did they have the signs that would count as an "agreement"? Perhaps. Worst case scenario, you go to court, they have all the proof, and you pay the fine.

I'd send them a polite but firm letter that, if the fine isn't removed, you will be forced to communicate with your lawyer for possible Americans with Disabilities Act violations.

Hotel space in this random parking lot were not marked? Toss the ticket, but if you want to be sure call the Tulsa King.

The fact that there is a "paid promptly" fee that is roughly 25% of the alleged fine makes this sound bullshite. Then, the only notice they give you is a note on the windshield? Any way they can prove you received the note? Was it just a slip of blank paper, or does it at least look official and include descriptors of your car?

Weird that a private business would even attempt to "fine" anyone while possessing no authority to do so.
Wonder if anyone was ever dumb enough to pay em.
