I don’t think these videos will help with the 3rd degree rape charge, but may explain why they haven’t been charged with her death or kidnapping

That is a completely different situation than what trial will be with a very very low standard compared to a very very high standard at trial. Also the judge was so convinced that he gave them pretty low bonds

And most in this thread has enough logic to understand how the law works.
The comments of the accused show they knew how drunk she was, which immediately to a logical person shows 3rd degree rape was committed. But to a juror, especially those that may be emotionally charged and not as logical as us or certainly a judge, things get muddy
If they truly can show her dancing with them, being flirty, etc etc, that will plant in the mind of some people. They won’t simply be able to dismiss and say “it doesn’t matter, she wasn’t of clear mind to consent based on later comments by the accused”

The fact there’s so many videos floating around should be telling. The fact these guys felt the need to video consent, video this girl doing whatever else etc, they knew they were in the wrong. They tried to obtain “good video” to put them in the clear in case she called rape. They knew this girl was drunk and clearly not making level headed decisions. It should have ended there.
