Even if they can shoehorn that into a libel case, shouldn't the penalty be commensurate to actual losses?

What actual losses were caused by Jones? I don't think their lives would be worth that in a personal injury/death case.

These types of cases make a mockery of our already shitty justice system.

It’s going to get reduced to the cap I would assume.

Punitive damages are there to discourage this type of behavior.

If party X is able to generate millions or 10s of millions in ad revenue, donations and product sales etc due to the spreading things X knows to be false, how is it just that the punishment for X is a fraction of that?

If I destroyed your whole life (worth 2 million for argument’s sake) but profited 5 million in the process, would it sit right with you for me to pay you 2 mil in damages and keep the 3 mil for myself?

Yeah but punitive damages are capped pretty hard everywhere I have seen because decades ago it was a free for all and easy to just write down big numbers.

Connecticut caps punitives at only legal fees.

And compensatory have to go through a second review instead of a jury writing zeroes.

It sounds good. But you would get the 2 million in that case. Not 5.

I don't believe either of them have been awarded a penny by a court. And if they were, it would be a pittance compared to this. Not even comparable.

I feel like Alex Jones called quite a few other mass shootings hoaxes. This one was not necessary he was already doing basically the same shite. Going after the parents of those small children it finally bit him in the arse.

Which is really stupid.

I think it’s reasonable that when a liable party commits their tortious action for monetary gain, all monies received in connection with said tortious conduct should be awarded. Why shouldn’t they be?

It doesn’t even have to go specifically to the “victims” of the tortious act.

Because the flip side is you have juries awarding absolutely stupid numbers for essentially no reason

Yeah, that one may be legit given we still know almost nothing about the shooter or the shooting itself. I don’t think the government did it, but someone connected to it in some way, probably. It’s bizarre how little we know about that.

Your original assertion is that no one should get ANYTHING for damaging lies spread about them.

Rittenhouse is currently preparing to sue multiple media outlets for defamation. Is he wrong for doing that?

Johnny Depp lost his biggest role because amber heard falsely claimed he abused her. Should he just chalk that up to the game and move on with his career in shambles?
