The speculation was that production hinted to them how it might be portrayed (i.e. by social media) based on the questions that production probably asked them during their DR sessions. Because like you said, Michael and Brittany didn't say anything about it originally, and then out of nowhere a day or two later (I think I'm remembering that time frame correctly) they started talking to each other about it. I remember think it was weird that they suddenly had an issue with it when they originally didn't.
And Julie did defend Kyle, but that doesn't mean that production didn't warn them about it.

And that continued to today when Michael and Brittany were alone after telling Alyssa about racist Kyle, they had the most obviously fake, just for the cameras dialogue about how they had no choice but to do it, it was the right thing no matter how it affects their game, etc... and Brittany even said something about America watching.

Narrator on tonight's episode ending by saying "who's going to win the veto in the BB classic slip and slide" and I was lmao guessing that Michael would win such a thing before he finished his sentence. I had no clue and looked it up and what do you know
If Michael wins HOH next week, he is going to be damn near impossible to eliminate as he will participate in every single veto for the rest of the season. Holy shite this dude is a comp monster.

The FCC made an opinion ruling back in the Donatos' year that BB is NOT a section 73 contest (I can explain if needed) nor is it a title 47 section 509 "Game Show". However, they don't actually have enforcement authority over Title 47 which is instead the DOJ. That said, I think the DOJ would find it for "entertainment purposes only" so no criminal action. The game show angle is a non-starter the show is set up legally so that production can do pretty much anything it likes in terms of manipulating the show. It is simply the situation the participants sign up for.

Big Brother isn't classified as a game show in whatever official capacity such things are done. That's why production can do whatever they want. Also from everything I've heard over the years, once you sign the required waivers to go through that door CBS owns your arse for at least a year from finale night. CBS isn't getting sued by any of the houseguests.

Here is CBS network stance on "subliminal messaging". Their own statement

Hot take: Michael should be off the show for slander and defamation of character. He knew about this for weeks and didn't care to bring up anything when it wasn't good for him. He's a lawyer, so he should know better.

Michael didn't say anything that wasn't true. He just purposefully framed it in the worst possible way. I think Michael is a piece of shite for this but Kyle still needs to explain his point of view. It really wasn't that serious.

I did not see any of the feeds at the time, the only mention of the Cookout 2.0 I saw was in the show when Kyle was talking to Brit. Did he make any comments to Michael himself?
Did Michael make an actual false statement? Kyle would be considered at a minimum a limited-purpose public figure so malice would have to be shown which is always an uphill battle and even more so given the context of a game.

Feeds came on and Monte, Terrance, Taylor, Alyssa, and Turner were in the kitchen. Michael was also there but left and Brittany was in the bed but got up and came into kitchen. The backyard was opened and they went outside. Taylor, Brittany, and Alyssa got into hammock and Brittany was starting to cry.

Kyle brought his concerns about a cookout 2.0 to Michael and then weeks later pitched an alliance of Micheal, himself, Brittany and Turner. Maybe Alyssa too. Michael used both of those to say Kyle was trying to get the white people to rally against the POC.
