Supreme Court finds Boston’s refusal to fly Christian flag unconstitutional

The Supreme Court on Monday unanimously ruled that Boston violated the Constitution by refusing to permit a Christian group to fly its flag outside City Hall while allowing other organizations to hoist their banners.
The justices said the city had run afoul of free speech protections by declining a request from Camp Constitution, a religious group, to fly a Christian flag bearing the Latin cross to commemorate Constitution Day and honor the Christian community’s civic contribution.
A pivotal issue in the case was whether Boston, by making a flagpole on City Hall Plaza available for use by certain outside groups, had created a forum for private speech, or whether the flying of third-party flags amounted to a government-backed message.
In a 9-0 decision penned by Justice Stephen Breyer, the court ruled that because Boston’s flag-flying tradition did not amount to government speech, the city’s refusal to fly Camp Constitution’s flag based on its religious viewpoint violated the group’s freedom of speech.
“When a government does not speak for itself, it may not exclude speech based on ‘religious viewpoint,’” Breyer wrote, citing Supreme Court precedent. “Doing so ‘constitutes impermissible viewpoint discrimination.’”

Nah, this is low hanging fruit and doesn't have much impact. When it comes to something like gay marriage or obamacare the liberals are going to fall in line.

I can’t wait for DeSantis to fly the Christian flag on an embassy and watch the left lose their mind. They will force you to fly their alphabet people religious flag but if a Christian dare try the same, how dare you!

It's a head fake because this is throwaway case. Give Miss "the courts are where policy is made" a chance for fundamental transformation and she's going to take it.

So? What are they going to do about it? The city got what it wanted, they've already been denied (and will likely be denied again).

The SC ruled 9-0, but they also stipulated that Boston would be okay to change the law so that this can be regulated. Boston will do just that to ensure this is no longer an issue moving forward.

How bad have you fricked up as a leftist when it goes like this? Not only do Sotomayor and Breyer go against you, Breyer writes the decision.

You have to be way on the far side of wrong to get a 9-0 SCOTUS decision

Idiotic. Who is to determine what is or is not a Christian flag? A municipal employee of Boston? Little does that genius employee know but an enormous bunch of things we use daily have roots in the Christian faith, like the names of days of the week, the calendar as a whole, etc...
Also how much do you have to add/subtract to a flag with the latin cross to make it "not Christian" and thus approved by this municipal employee?
And what of flags that have multiple use, such as cross of St. George or St. Patrick? The flag of England, Alabama, Florida, Lithuania, Georgia (country), etc... It has a Christian saint for a name, does that mean it doesn't pass the test?
Another good question: how many hungry people were fed this year as a result of the ban on flying this flag? More kids get an education? Spousal abuse curtailed?
Oh how I wish to be a civil servant, tilting at windmills only I can see.

ABC News - A wave of unanimous decisions
About 2/3 of the cases in the 2021 term were decided 9-0, or with one Justice dissenting. It’s a fairly common result.

One of the most common symbols of Christianity you see everyday is something called the "six panel" or christian door.
Top two thirds of the door are a cross and the bottom two panels are meant to depict an open bible. Its the most common door design in the United States, many of you probably have that design in several of your doors at home and never realized. Now that you know you will see it every time you enter a room

Seems pretty reasonable. they just need to put a process in place or set the rules or the flagpole usage and let whoever fly whatever. Free speech winning is always great. Even if the particular winners here aren't a great cause.

You know it’s bad if the entire court agrees
