Feds are not going to let Jason Williams screw up the Costco carjacking/12 year old murder

Williams’ office has not yet made charging decisions on numerous allegations brought against Harris since his arrest Sunday by New Orleans police. But the local DA is on record last Nov. 10 refusing an armed robbery case against Harris submitted by the NOPD after an alleged car theft at gunpoint that occurred in August 2021.

Feds probably want to do an even worse job than Jason Williams on this one. Probably gonna try a holistic midnight basketball approach.

Here is the federal carjacking statute:

18 U.S.C. 2119.

Whoever, with the intent to cause death or serious bodily harm takes a motor vehicle that has been transported, shipped, or received in interstate or foreign commerce from the person or presence of another by force and violence or by intimidation, or attempts to do so, shall--

(1) be fined under this title or imprisoned not more than 15 years, or both,

(2) if serious bodily injury (as defined in section 1365 of this title, including any conduct that, if the conduct occurred in the special maritime and territorial jurisdiction of the United States, would violate section 2241 or 2242 of this title) results, be fined under this title or imprisoned not more than 25 years, or both, and

(3) if death results, be fined under this title or imprisoned for any number of years up to life, or both, or sentenced to death.


Seems like that could apply to most carjackings.

That’s an extremely odd turn of phrase. As long as it’s a violation of federal law (and at this point, damned near any crime is arguably also a violation of federal law), the feds can concurrently prosecute under the separate sovereigns doctrine. Now, usually either the feds or the state decide not to waste their resources doing so if the other has picked up the case, but it happens. Neither can “take” a case from the other.

I just don’t get why Williams is allowed to make all of these terrible decisions. Most of them directly contradict his job title.

Article V, Section 26 of the Louisiana constitution explicitly states that "no district attorney or assistant district attorney shall appear, plead, or in any way defend or assist in defending any criminal prosecution or charge. A violation of this Paragraph shall be cause for removal."

I guess he technically can't "in any way defend or assist in defending" a prosecution or charge that is never brought.
