You obviously missed this part. Living in an HOA is a pain in the arse ,but again if you live there that is on you. They have rules most are very strict and most will enforce everything and they are ridiculous ,but he signed up for that.

I don't like paying money to be told what to do. Without one, my neighborhood is fine wrt security, upkeep, etc.

I think it sucks. We have an HOA, they are almost non existent. They patrol the yard sign and the trailer/RV parking thing pretty hard. Rarely do they get someone for maintenance. We do have a disabled guy in a motorized wheel chair that has set up one of those gazebos in his driveway that now serves as his hangout, crawfish boiling, grilling spot. I guess they are just letting him roll with it.

To me, it's not altogether unlike the school prayer debate. Advocates of prayer in public school usually take for granted the type of prayer that would be said, never considering that it might be a Muslim prayer on occasion, for example.

Of course. Just look at the people defending the HOA in this thread. They are the same ones who champion the police state, TSA, and Patriot Act. The thought of life with no overlord direction is terrifying to them.

Look, it is a bad take but the HOA is technically not wrong. They aren’t suing for the flag pole. They are suing because they didn’t their money from their architectural review board aka neighbors approving stuff you can/can’t put up and charging a fee for the approval. He did not fill out the necessary and required paperwork and pay the fees so that is what they are going after. It isn’t about the flag pole, it is about doing something outside of the covenants that you agreed to when you signed up to live there.
That being said, it was $50 and has turned into $8,000. The HOA clearly escalated this beyond reason.

My HOA? I wish they would do more to keep properties better maintained around us… Home values have skyrocketed from under 300,000 in 2005 to about 800,000…
Our community is now 30 years. Old property values are between 650 and $800,000. That’s a lot of money but I can tell you as you drive around a lot of the houses certainly don’t look like they’re worth anywhere near that value because the Landscaping is not very good….
So no, I don’t defend the HOA being stupid over a flag

There is a difference.
This isn't communist China. If the man wants to fly the flag of the United States of America, then I fully support him.
Every other person in that neighborhood that disagrees with the HOA should put up their own flagpole in the front yard to make a statement.

I despise HOA‘s. But if you read the article, you’ll see the lawsuit is not about him flying the flag. They do not outlaw flags or flag poles. You simply have to obtain prior written approval, which he did not. The simple solution would be for the HOA to offer him retroactive approval if he filled out the paperwork. I do not see that they did that in the article. They suck.
Something similar happened with our HOA. A guy painted his door. The HOA threatened and eventually sued because the color wasn’t approved. He stood his ground. Ended up costing both him and the HOA thousands of dollars. The judge then approved an even uglier color. The HOA was not happy
