Did you miss the part where the state law allows a flagpole up to 20 ft? The HOA does not supersede state law.

Often the ARC review requires a fee with the review request. I've seen the fee in the thousands.

I get that, but the OP statement is misleading, he's said they're not letting him fly the flag, it's about the flag pole. He has an American flag on his house, which no one is complaining about.

I get that the pole is legal under Florida law, and the HOA is full of shite, but flying the flag is not was the law suit is about.

I can't stand HOAs, and I chose to live in a neighborhood that doesn't have one. Screw those slimy cock suckers...

Anyone who sides with a HOA on any issue is anti-American. For every example of a house bringing down neighborhood values there are 1000 examples of petty bullshite where all the money people pay gets used to sue or put liens on houses for asinine and infuriating reasons.

I’m interested in seeing how the law gets interpreted. Will it be seen as the law only preventing local governments from blocking residents in general from having a flagpole or will it apply to private neighborhoods also?

Nothing is illegal about storing a boat trailer in your driveway in my town / parish, but our HOA still prohibits it. Its part of the bylaws / rules we agreed to when buying in this neighborhood.

HOAs can do some things that are helpful but too often they turn into a committee of Karens and become a nightmare shitshow.
