The election is in 29 days. I could write a pretty good petition in 6 hours, citing case law* and whatnot. Roy has forgotten more Constitutional law than I'll ever know. And you mean to tell me the campaign couldn't spend a few grand to hire some bad mofo write the petition over the weekend?

*I'm well aware the suit has little or no chance of success and that the burden for libel of a public figure is nearly insurmountable... but I'd still file suit.

He ain't innocent, dude, and is a child molester and guilty of statutory rape since he had a thing about dating and having sex with middle school and high school girls. Roy is a pervert, and it is going to be interesting to see is will the Gumps elect a child molester to Congress. If so, it will set Alabama back 20 years in perception around the country -- even the Red State Country. This one crosses the line.

Because he would open himself up to further discovery aspects, and it would be a failed attempt anyway if he tried

the problem is they need to show clear malice that they knew for a fact the story was false, thats pretty hard to prove even if you can show its common sense to assume it.

look at all the poli board legal eagles. He has plenty of time to file the suit. Rushing it may help optics, but being deliberate and thorough is pretty important when you file a petition. To call him guilty or question his legal acumen because a suit hasn't been filed already is silly.

Now there is wisdom in not filing once you’ve won whether the accusations were true or not. Risk/reward is inverted once you win.

Could you establish an ironclad timeline as to when the accuser might have potentially known Moore in six hours? Could you make contact with the woman who claims to have the recording of a WaPost reporter offering payment for a false allegation? I don't doubt that you could throw together a frivolous filing in a few hours and get your name in the paper but if someone wanted to seriously go to war with a major newspaper they would build their case first and not assume that they would have time to do it at their leisure with the Wa Post pulling in favors from all quarters in their effort to score an early dismissal.

Hey man. I told that other Boosie to F off. That we already have a Boosie. This is how you repay me?

I will admit if no suit is filed there is something in his past he doesn't want to talk about. We both know discovery doesn't always stay limited to relevant facts. However, he could non-suit it anytime and long before discovery took place...so I don't think it is much evidence one way or the other.

I would be very careful in filing a libel law suit. Any skeleton in your closet...illegal or not...will be national news.

I'd also be wary of counterclaims that would then take away his unilateral power to dismiss at his leisure. It'd be tough to find one that would stick and be viable, but that's also the danger in opening up the litigation can of worms.

Agreed. It may not be diddling 14 years old in the woods, but I'd imagine there is some smoke to this fire if he doesn't file before the election.

Now i'm no lawyer, but i believe it would take a little time to gather the information for the suit. In addition, i'm sure Moore's lawyers are tied up with this whole election thing.

Let me ask you, when WAPO does end up getting sued, will you come back, start a thread, admit you were wrong, and apologize?
