It remains hilarious that Trump tweeted after Flynn's plea, "It is a shame because his actions during the transition were lawful. There was nothing to hide!" and then Dowd took the blame for the tweet. And yet Dowd continues to work for Trump. Hmmm...

On the Logan Act thing, you would then have to prosecute a person in just about every administration going back to at least Eisenhower. I'm not sure that the NSA designate, which Flynn was during that time constitutes a "private citizen" in the context that the law was framed. He would be allowed to tell a foreign government that because of an upcoming change in policy by the incoming administration, that it would be advantageous to his side and our side to restrain his side on fighting on the sanctions.
There has never been a successful Logan Act prosecution since its inception in 1799. In fact there have ever been 2 indictments with the last being in 1852, both failed.
Taken in that context, it boggles my mind why Flynn would have lied to the FBI about it, unless he's stupid or has a bad lawyer. He should have told the FBI that this was a matter of new national security policy by the incoming administration and as such the FBI needs to back off since the FBI does not establish United States policy in regards to relations with foreign governments. In that context he could tell the Russians or anyone else, that it would be to their benefit to do that which would entail some sort of implicit consideration.
