Judicial system screwed up
The rest of the tragedy.
In May of 2019, a man being treated by medical crews outside an Appleton transit center suddenly opened fire on first responders.
Firefighter Mitch Lundgaard was killed.
The shooter, Ruben Houston, died in a shootout with police.
Now, three years later, the Milwaukee Journal Sentinel reports a mistake made just days before the shooting allowed Houston to post a reduced bail and to be out on the street.
"That should never have been allowed to happen," Fond du Lac County District Attorney Eric Toney told WISN 12 on Monday.
He said a judge reduced Houston's bail from the $5,000 requested by his office to $500 because neither the district attorney nor the court was aware Houston had a long criminal history.
How did that happen, WISN 12's Kent Wainscott asked Toney.
"What we didn't know at the time was that a judge had allowed him to change his name all the way back in 2011. We actually didn't learn that information until last week," Toney said.
Houston simply added an "o" to the name Huston.
Name changes can be easily found in online records, but in this case, apparently, no one found it.
Toney said it never showed up in the case files.
Neither did Houston's past felony record, including time spent in federal prison.
Something else that's putting the case back in the spotlight is politics.
Toney is running for Wisconsin Attorney General.
He was among those who have called on Gov. Tony Evers to fire Milwaukee County District Attorney John Chisholm.
WISN 12 reported about the reduced bail and Toney commented on it in 2019.
But Houston's name change never came to light.
Now with a political race at hand, the campaign manager for his Republican primary opponent, Adam Jarchow, blasted Toney saying, "This level of hypocrisy is unacceptable in our politicians."
Toney disputed that charge and called the Houston case "a tragic constellation of events."
"This is a hole in our system that must be fixed to make sure tragic events like this like ever happen again," he told WISN 12.
Toney said he wants the state legislature to place stricter requirements on judges to consider criminal history before allowing someone to change their name.
