Literally the entire purpose of the court system is to provide that check on enforcement.

because that’s never been what the AEA is about.
The president has never needed the AEA to combat the invading force
If Canada invaded with tanks and whatnot he would just send the army to shoot them and blow them up.
the point of the AEA was
if Canada invaded the President can round up every Canadian in the US and either boot them, or hold them till after the invasion/war
Real life example, the AEA didn’t empower the soldiers to shoot at planes at pearl harbor
it empowered FDR to put japanese people living in america in containment camps
