Per page 9 of part II of the Mueller Report, in order to be found guilty of obstruction of justice, the prosecution must show:
1) there was an obstructive act
2) there was a connection between the obstructive act and an official proceeding, and
3) corrupt intent.
The Report states that the evidence they obtained did not establish that Trump was involved in an underlying crime related to Russian election interference (Part II, page 7), and “the absence of that evidence affects the analysis of the President’s intent and requires consideration of other possible motives for his conduct.”
There was no underlying crime. There was no clear “corrupt intent.” Therefore, even if I give you there was at least one “obstructive act,” you still have to prove corrupt intent and with no evidence of any underlying crime what is the corrupt intent?
The requirement of “corrupt intent” for obstruction of justice is essential, and this situation perfectly illustrates why it is essential. Trump spent a year and a half relentlessly working for the Presidency, and was justified to be pissed at anyone around him who allowed the “Russia cloud,” without any evidentiary basis, to hang over his Presidency. An innocent man facing unjust prosecution has the god given right to fight back. Certain acts in “fighting back” may qualify as an “obstructive act,” but if there is no corrupt intent then those “obstructive acts” are 100% legal!
