It is not. At best, a misdemeanor. Just provided because it is pertinent to the previous discussion.

OK. I think the Congressman is just trying to get some hype. He should be laughed at for recommending a US Attorney get involved. The whole thing is just a sad situation. Supposedly the guy lost his job at Five Guys already over this. Death threats, etc.
