Right but you said a “warranties search” was conducted. I don’t know what that is. Could you explain it?

Police generally need search warrants to conduct searches. Searching without first obtaining a search warrant would constitute a warrantless search.

You do not need a “warrant” to conduct a search incident to arrest.

It's more BS in the article

quote:

When police lawfully arrest someone, they may search:

The person

Clothing and belongings

The area within the person’s “immediate control” (to check for weapons or evidence)

It was a ghost gun. He should have worn gloves and ditched the gun next to the body. He never would have been caught.

You haven't read the digital forensics they used to track him down. His arrest has very little to do with the gun.

Confessions are great to have for convictions but obviously are not absolutely needed in all convictions.

I’m not saying the defense attorney argument is valid.

“warranties search”

Just what it says. A search without a warrant. There are exceptions to admissibility for evidence that is obtained with a warrantless search.

Read the article. I didn’t make that determination.

Yes, we get it. You are excited this might get a guilty murderer off free because he killed someone you hate personally & politically because of what his job was.

No. You don't have to keep talking to them either. If you do, that is your decision. Simply saying "I don't want to talk" isn't good enough. You have to also not talk.

Since when does this apply to a bag you had with you when you were arrested?

Only a smooth brain would read the article and think the defense was magically going to get all this evidence thrown out.

It's a defense team with little shot of winning. Of course, they are going to sling poo at the wall.

Imagine being retarded enough to read the article, and be so amazed by it because you don't fully understand it, then post it here like it's worthy of discussion.

Seems like the person being questioned could also just leave. Walk away.
