No. New York state business records law
To my knowledge, they are also tying it (ludicrously) to New York state election laws.

Are you under the impression that city prosecutors can just bring Federal Charges whenever they want?
Posted on 3/31/23 at 2:27 pm to omegaman66
Anyone know the statute of limitations for these?

Its complicated.
The SoL already passed for the "real" charge, a misdemeanor.
So they had to do some incredibly bullshite legal wrangling to make this a felony and I believe the SOL was 2024 for that.
Its total nonsense but we are here anyway.

To make things more complicated, I think they have a weird tolling function if you're physically outside of NY or something.

If this is on the federal level, yes. On a state level, no.

I have not followed the legal aspects of this case as closely as others, admittedly.
I've heard enough to know its total and complete nonsense.

Because I'm a lawyer and know what I am talking about and you do not?
You are utterly clueless.
Nope. You don't even know what the charges are, so there's that... The "falsifying business records" is a possibility, I suppose, but considering there is evidence of Cohen saying explicitly (before the plea deal) that he paid the money and was never coerced or reimbursed by Trump, and Stormy said that there was no sex... seems like a stretch. But then again, people tend to abandon all logic when it comes to TDS.

What don't you understand that this is the City of New York DA bringing state charges, not a Federal Prosecutor?
It is a state case. He cannot pardon himself for them.
Are...you under the impression that all "felonies" are Federal?

1- you cant pardon yourself
2- its a STATE crime he POTUS can only pardon FEDERAL crimes

Negative, ghost rider. At least not for these charges.

On the flipside, even if Merrick Garland:
Charged Trump with a crime
Got him convicted
Trump could still run for office and win. Nothing in the Constitution prevents him from doing so.
And there is no answer to whether he could actually pardon himself. Nothing in the Constitution specifically prevents it.

Everything I have read is they are using New York State election law as the basis

Generally speaking they cannot.

You don't even know what the charges are, so there's that..
We know the jurisdiction.
You think a NYC ADA can moonlight as an AUSA and file charges in federal court based on NY state law?
