True, and I misunderstood your question about membership being voluntary. It is voluntary in only the most general sense and a law school who chose not to let ABA accredit them would lose a lot of money and students.

But if the DOE refuses to recognize the ABA as the national accreditor, then something will replace it - whether regional bodies or another national body, and that would destroy the ABA's power. So, yes, you are technically correct, but functionally no law school would care about ABA accreditation at that point. Why would they want to comply with two accreditation bodies?
