Those concerns are typically centered around the 4th Amendment, both in terms of where ICE can/can't access without a warrant and countering their dishonesty about what they're permitted to do.

Here is my understanding. Many have temporary legal status- paperwork allowing them to be here until a certain date ( fact).. For many, that date has been extended multiple times (fact). So if they avoid law enforcement they can keep working( fact) . If law enforcement catches up to them they get deported even if they have that temporary status ( I think ).

On the other hand, since when are foreign agents and assets "permitted" to violate our border without proper authorization or permission?
It can be claimed that ICE is in active pursuit of dangerous, unauthorized foreign agents who have already engaged in illegal and criminal activities by encroaching upon our sovereign border to begin with; By default this technically makes them all fugitives on the lam. Those who are hiding them can also be considered aiding and abetting.
