Not an attorney, but think it may need to go through the NY Supreme Court first.

No.

Has to be ruled upon by highest NY court first.

Most likely true but possible that this case could get bumped to Federal level due to timing around this bond thing.

I think it stays in the state courts but the timing of the bond could create a new case for violation of 8th amendment rights and thus issue a stay while it plays out in NY courts. This would only happen if the state courts fail to be reasonable and do not act.

President Trump has no chance of a fair hearing and/or trial anywhere in NYC or NY State.

My recollection is that it must first go to NY’s high court, which they call the Court of Appeals (or something like that) instead of “Supreme Court.”

No. He has to run the gamut through the NY state system first. Additionally he has to pay thesupersedasor defendants bond first.

Where is the relief in this situation when it is clearly an 8th amendment violation?

This is lawfare at its finest.

Unfortunately he's in a bind. In order to appeal he has to post the bond or else the status remains static. Sure, he could file a suit in federal court but, chances are it does not get expedited so it becomes a drawn out process. His only hope is that after the NY property is seized, he files in federal court and a stay is placed on the state from disposing (selling) of the property until a resolution comes about.

All rents collected would go into an escrow account and I suppose a special master would be appointed to oversee the monies and disburse said monies for things like maintenance and upkeep, etc. If I were Trump, I would press the court that while the stay is in effect the state is responsible for making sure tha the taxes are paid on the properties seized and he is not left holding the bag for that....because the bastards would do something like that.

This won't be an expedited matter. By being in a state court, given the biases inherent you are looking at a minimum 3 year process. I doubt even him winning the Presidency changes anything substantial on the state level, in fact it may prolong it.
