I don't regard this institution very highly. They gave us dred scott, Korematsu, plessy, and roe.

they have become to powerful IMO.

with one court ruling they can change law in the entire country.

Ex.
RVW
Gay Marriage in the near future.

The Supreme court kinda has final say on many laws and they don't have any oversight, other than people appointing them to take positions.

Thoughts? That this dude has not read a single, and I mean a single piece of the correspondence between the framers regarding the second amendment. Anyone who has clearly understands what the intent is.

Oh you mean a background mainly made up by the English Rights of Man? Where every man should be able to have a gun if the government or king (either way a potential tyrant) could?

Yep

No idea as it just popped across my feed. However a simple google search of "warren burger gun control" is pretty telling. He may have said it.

this issue will never be settled the language isn't specific enough there are ways you can read it that support both sides.

Founders never thought future Americans would have such trouble with English.

Politico had a long article up today:

How the NRA wrote the 2nd Amendment

I was curious as to the veracity of the facts cited in the piece. A lot of it was at odds with what I thought I took as known history.

This quote from the Politico article is particularly troublesome:

quote:

Few dealt with preventing gun violence, social science findings or the effectiveness of today’s gun laws—the kinds of things judges might once have considered.

It's not the job of judges to decide what is good social policy. It's their job to decide what is constitutional and legal.

so basically this former judge never read the federalist papers or read about what any of the founding fathers said about firearms.

interesting.

quote:

FINAL WORDS FROM THE FOUNDING FATHERS ON THE RIGHT TO KEEP AND BEAR ARMS

"I ask, sir, what is the militia? It is the whole people.... To disarm the people is the best and most effectual way to enslave them.... " --George Mason
"No free man shall ever be debarred the use of arms. " --Thomas Jefferson

"Arms in the hands of citizens may be used at individual discretion . . . in private self-defense. " --John Adams

"The Constitution s hall never be construed to prevent the people of the United States who are peaceable citizens from keeping their own arms. " --Samuel Adams

" . . arms discourage and keep invader and plunderer in awe, and preserve order in the world as well as property. ... Horrid mischief would ensue were [the law-abiding] deprived of the use of them. " --Thomas Paine

"[The Constitution preserves] the advantage of being armed which Americans possess over the people of almost every other nation...[where] the government s are afraid to trust the people with arms." --James Madison

"A militia, when properly formed, are in fact the people themselves...and include all men capable of bearing arms...To preserve liberty it is essential that the whole body of the people always possess arms and be taught alike...how to use them." --Richard Henry Lee

"A well-regulated militia, being necessary to the security of a free State, the right of the People to keep and bear arms, shall not be infringed." --Amendment II, Constitution of the United States

I find it crazy that some can still believe that one of the rights listed in the constitution, would be contingent on being a part of a governmental organization.

Seriously, that is what they are trying to argue. Craziness.
