Like I said, I haven't followed this that closely, and I hope it does go away because its stupid.

But I've been a bit baffled for a few weeks now about how Fani Willis's issues means the case goes away.

I am really not sure that is the case at all. I've seen DA offices get recused from cases and the trials were delayed maybe 4 months or so.

I don't think this is right. She hired a special prosecutor to investigate and bring the action. I do not believe she turned the case over to Ward without involvement from her or her office. Fani said three weeks ago that she would not recuse herself. That statement would not even make sense if Ward was independent counsel.

The timing of the case is pretty important to the 2024 election, as the entire point is to try and DQ him from the race.

If this gets kicked past the election, there is a 50% shot he is a private citizen and won’t run again in 2028. At which point they have little need to push this hard.


If he wins the election, this becomes a very prolonged legal fight because a state prosecuting a sitting president, much like Paula Jones’ lawsuit against Clinton, means that it gets very complicated.

At that point, the state would have to decide if it is still worth pursuing given the extra scrutiny and the fact that Trump, as executive, can handle materials to help or hurt the case differently than the Biden administration could.

The Motion to Dismiss claims that Willis and Ward failed to provide documents requested by the defense and that they have an improper relationship. The case could go away if the failure to disclose allegations are true or if the Willis-Ward shenanigans amounts to prosecutorial misconduct. The focus has been on the increasing mountain of evidence that Willis has lied as an officer of the court. I haven't seen much reportage on the other issues.

The official reason for the case is a criminal prosecution.

Lawfare pushed this particular case hard because they wanted a conviction against Trump before November in order to kill his election chances.


If it doesn’t impact the election, it is no longer nearly as useful to them.

I thought it wasn't about the case "going away," but more about them not being able to get him convicted before the election because of all the delays this corrupt idiot's shenanigans have caused.

Both. In this particular instance, the SP is more like a contract attorney leading this prosecution, not like what federal law considers an independent special counsel like Mueller, Jack Smith, Starr, and the like.
