“I got a cash offer. It was under contract,” she said.

That’s when Daure says Vincent Simon apparently moved in. Simon claimed he had a lease and that he’d paid $19,000 upfront for six months.

“The police call the number that’s on the lease. It doesn’t exist,” Daure said.

Daure went to the police and was told it was a civil matter.

Daure saw him moving giant safes into the house.

Gray went to the home multiple times to try to talk to Simon. He never answered the door.

Daure says the sale of the home appears to be off and all she can do now is wait for the eviction process to play out.

“I want to go shoot out the windows, turn off the water, cut wires, but I can’t. That’s a crime. Law-abiding citizens can’t do that,” Daure said.

This squatters rights bullshite needs to stop.

She should be able to round up a posse and clear this up in minutes.

So, you are upset that this is a civil dispute under local law rather than a criminal matter?

She has to file an eviction. Egads, it is almost like Mad Max.

Trespass is a criminal matter, is it not? It seems to be a logical perversion to treat trespass as a civil eviction item just because the trespasser used fraud in the form of a false lease and duration.

I do not disagree, but it universally how such matters are handled. It is not unique to Georgia or to this LTC. The OP reads like it is some unique miscarriage of justice.

I never could understand how people get away with this as it’s theft of property. That said what stops the owner from moving in themselves and make it miserable for the squatter? Play loud music, turn on/ off lights of any room they are in. Raise the heat to levels that they cannot take. If you are living in the same house then don’t pay the electric bill, charge locks on doors when they exit. Make that person want to leave an if they come back and try to enter call the police as possible robbers, rapers. If a husband is told to leave in a domestic dispute he can have a restraining order against them to keep away, why not in this situation?

Serious question. Why does someone have to file and eviction notice to stop someone from trespassing? I though evictions were for people behind on their rent?

If you get a legal eviction order the sheriff will throw out the squatter for the landlord.

This isn't rocket science.

Now you know Hank that the damages generally done on houses is usually extreme with squatters as well as the outright loss of housing for yourself and with additional costs for suitable housing for yourself. The additional litigation costs, including potential liability for injuries during squatting. My grandfather a century ago lost acreage of property over this tactic of squatting

If you want an analysis of the legal theory, squatters are handled this way in Anglo-American law as a prophylactic approach designed to prevent potential violence arising from self-help.

Just look at the posts ITT. Mentions of a "posse" and gunfire and creating a hostile environment in the residence. The law is designed to prevent violence by discouraging that sort of behavior.

EDIT TO ADD: "Beat the shite out of the trespasser."

It should be getting tossed out on your head.

Squatters shouldn’t have rights. That’s the point.

This lady is being finically harmed through the illegal actions of some twat and now has to wait for the courts to remedy it at her expense.

It’s bullshite and everyone sane knows it.

Sure, that's all true. That doesn't change the legal process though. It's the same across the country regardless of where you live.
