In order to claim imminent danger, there has to actually be imminent danger. Not some dumb a-hole standing around saying, "Well, who knows, he could have wanted to hurt someone."
The guy didn't even drive the car anywhere. I don't even think the car was cranked.

Killing an illegal in self defense has to be the best case scenario. His family won't want to out themselves with a suit.
