Why would he do this as the driver has a gun?

Must've thought the driver wouldn't use it. A miscalculation.

The guy may have still intended to run over every one of his family members.

LOL.

Or, he may have intended to enter the car in the nearest NASCAR race. Or convert it into Dr. Emmet Brown's time machine.

In order to claim imminent danger, there has to actually be imminent danger. Not some dumb a-hole standing around saying, "Well, who knows, he could have wanted to hurt someone."

The guy didn't even drive the car anywhere. I don't even think the car was cranked.

Some of the people on this board are shockingly dumb.

I am amazed that you're ignorance

The police department has already come out and said that he will not be charged and yet here you are arguing that he's gonna be convicted

But of course you might know more than Texas does

Not guilty
should not even be charged with anything

shame on Texas if charges are brought

more of this will go a long way towards solving a lot of problems

I still don't know what Jose was doing. Why would he come up to a driver who clearly has a gun? There is something more to this.
do not care - frick him - he got what he deserved

no matter what happened or what the disagreement was, trying to take a car with kids in it is next level - he deserves to die for that

I love a story with a happy ending

It's my understanding that in Texas you can use deadly force to stop a property crime. Is this correct? EDIT: I looked it up and I'm not sure that guy is going to get off. You can use deadly force to prevent a property crime, but there are restrictions and I'm not sure this case qualifies based on the restrictions. I don't think the guy can claim imminent danger. His entire family had exited the vehicle by the time he shot the guy and he knew it.

He would if I'm on the jury.

Hopefully the gun was legally obtained and possessed.

You mean like the armed carjacker who was then in possession of a 2-ton weapon?

Glad the shitbird is dead. Now we don't have to deport him.

Good shoot.

Even still, the shooter was quite restrained. That carjacker was intent on courting death.

Police already said he likely won't be charged with anything.

Killing an illegal in self defense has to be the best case scenario. His family won't want to out themselves with a suit.
