Washington — The Supreme Court on Thursday ruled that race-conscious admission policies of Harvard College and the University of North Carolina violate the Constitution, bringing an end to affirmative action in higher education in a decision that will reverberate across campuses nationwide.

The court ruled 6-3 along ideological lines in the University of North Carolina case, and 6-2 in the Harvard dispute, as Justice Ketanji Brown Jackson recused. Chief Justice John Roberts authored the majority opinion, joined by Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett. Thomas read a concurring opinion from the bench. Sotomayor also read her dissent aloud, the first time a dissenting justice has done so this term.

"The Harvard and UNC admissions programs cannot be reconciled with the guarantees of the Equal Protection Clause," Roberts wrote. "Both programs lack sufficiently focused and measurable objectives warranting the use of race, unavoidably employ race in a negative manner, involve racial stereotyping, and lack meaningful end points. We have never permitted admissions programs to work in that way, and we will not do so today."

Why just in higher education? If affirmative action is Unconstitutional, isn't it unconstitutional in all things?

Correct. The opinion covers all. Higher ed is getting a lot of attention, but this case serves as precedence if say, someone is passed over for a job and there is proof that the reason is race-based.

Maybe with this decision more cases will be brought challenging AA in other areas.

I love it… Justice Clarence Thomas says the U.S. is based on equality and that our Constitution is color blind.

Sotomayor attended Princeton University. She has said she was admitted in part due to her achievements in high school and in part because affirmative action made up for her standardized test scores, which she described as "not comparable to her colleagues at Princeton and Yale.

Yes. Would be curious to hear our resident legal scholars opinions about whether this ruling becomes precedent for corporate hiring policies?

The colleges use 'striving' to circumvent the court.
They don't have quotas for blacks. They have quotas for 'striving.'
What is striving? It's overcoming an obstacle in life. Like being black.

So now our higher education institutions can be completely flooded with rich Asian kids that go back to Asia post graduation. Fantastic

It's a common sense decision IMHO.

Great win for society in general, and I hope and pray it transitions into other decisions to prevent this racial bias.

Employees have been successfully suing employers for racial promotions for decades. Affirmative action did not alleviate employers from damages awarded to employees who could prove equal opportunity was not afforded for promotions.

Universities, however, were granted more latitude because the perception was to quota for the purpose of righting past wrongs, the broad nature of what goes into admissions (not only merit), and the sheer volume of applicants and admitted freshman.

This is a big win for the Asian communities.
