Smollett should have been punished to the max extent. But the Prosecutor has the authority to make the deal. It was lenient and sucked, but it was her choice and within her power. I don’t like the second guessing and re-examining of a DAs decision by a special prosecutor. Bad precedent.

But would be great to see Smollet go to prison and Foxx with him... they could be cell mates since she’s more of a man than he is.

Pretty sure that only applies in cases of acquittal, not when a prosecutor declines to pursue.

Double jeopardy doesnt "attach" until trial. In the case of a jury trial it attaches immediately upon the swearing in of the jury.

This is what I don't understand - I thought that regardless of how screwed up the situation was - that any 'official' ruling by the state meant = no double jeopardy.

To do otherwise, would they not have to conclude that the ENTIRE PROCESS was a purposeful FRAUD = a conspiracy to UNDERMINE the system. And that would have to include liability from EVERYONE involved in the conspiracy - from Kamala Harris and Cory Booker to Michele Obama.

I HOPE this is the case - but I doubt they could make that stick.

OR - is there really a legal way to overrule prior mistakes by state officials re-prosecute a once-'adjudicated' person?

is it possible they are just finding NEW crimes to make him liable for??

Hopefully this entire episode will be re-investigated and ALL the corrupt elements brought to justice.
