This case is not being tried in Miami, it is being tried in Fort Pierce. The jury will be drawn from Highlands, Okeechobee, Indian River, St. Lucie, and Martin counties.

When I lived is South Florida, I worked a lot in those counties. They are conservative. I can see a hung jury easily occurring if not acquittal.

Exactly. Smith's prosecution is using a novel legal theory. Yet he assumes SCOTUS is going to rule on something that has not even happened? If SCOTUS is not political, SCOTUS does nothing.

I think the electorate deserves to know if he can be prosecuted for this or if he has absolute immunity before we vote. The only reason to delay this is Trump is hoping to win and pardon himself. Let’s be honest in that being the play.

1) The SCOTUS did grant expedited consideration of the writ, so there’s a chance that this matter will be considered and reversed, bc why the hell else would they grant writs;

2) last I checked I can be sanctioned for filing pleadings with no basis in law. I’d imagine the sanctions should be worse for a federal prosecutor. Good luck appearing in Federal Court if you engaged in a prosecution in order to throw a presidential election.

3) the SCOTUS has granted writs in one of the J6 cases pertaining to the impartiality of the jury pool and on 8th amendment grounds regarding sentencing, and even whether the J6ers “obstructed an official proceeding” as intended by Congress

So lawyers probably smarter than me and you have drafted these arguments in less colorful fashion. And the Supreme Court, full of other lawyers who are probably smarter than me (with the exception of Soltamayor who isn’t smarter than most ppl who regularly posts on this board), have found them worth a second look.

4) calling these legal arguments “fan fiction” is probably a stretch

Let’s be honest that being able to prosecute a president is the play. It makes a man want to roll out of his chair laughing that the special counsel for the DOJ, who filed charges against POTUS Trump, does not know if he had the right to do it.

This isn't complicated.

The people who would be to blame for Trump not winning will be people who don't vote fore Trump.

It is in the best interest for everyone for the SCOTUS to handle this now. If this goes through the lower courts, it will not be resolved by November. If one lower court rules in favor of either side, the other side will go ballistic asking the SCOTUS for an emergency intervention before November.

You also have the current administration that can also make the same claims that Presidents are immune from prosecution, which can set up a crisis before the next election.

When you know that the intermediate appellate level will be appealed, then no. It's literally pointless if the superior appellate level advises it will accept writs on the case.
