That is the better analogy to the current impeachment status. The lawsuit has been filed. The indictment has been obtained from the grand jury. But the defendant/POTUS need not do anything until he is “served.”
Except that the DA has been told by his boss to not even try to serve him because they know they can't win.
OK, that is probably accurate.

But I do not see how it is especially relevant to the OP’s procedural argument.

Trump has been Impeached, from what I can gather. Nancy will send it over to the Senate for trial at her discretion.

IMHO, what's happening now is that the Dems and GOP Trump-haters are whipping up votes in the Senate to Dump Trump.

The votes will never be there, but, the Dems still have a good propaganda message: "Trump is Impeached and refuses to resign".

I guess it just depends on if you're talking about technicalities or real consequences. Technically the Mueller team "indicted" a bunch of Russians they don't know and who will never, ever be served or brought to trial. So it's an indictment, but not in the sense people typically use the word.

If it doesn't go to the Senate for a trial then it's no different from a DA saying they are going to file charges against someone but never actually filing them then trying to say they've been charged.

This withholding is biting them in the arse in ways they didn't think it would and it's glorious in how appropriate it is.

Bird beat me to the analogy

The idiots voted the Dems back into the House less than two years ago, brosef. You think that was an anomaly? That was the norm.

I don't think it matters whether she sends it over or not. Mitch McConnell is just waiting for his opportunity to dismiss. That's what can and should happen.

They voted “to impeach” but that means referring articles of impeachment to the senate. That is like me telling a homeowner with a house for sale “I’ve decided to buy your house” but never offering up a contract. Did I buy a house? Nope.

BFD either way. It was an entirely partisan process by a group of people who have no idea what statesmen are. If the founders had been like these people we would be a third world country.

He's been impeached technically but he is not going to be removed. No matter how you slice it the end result is the same, if Nancy hangs on to it the senate won't have a trial and Trump does not get removed and if she sends it on it will get shot down quick in the senate and Trump still stands.

I'm assuming the dems will try to drag it out in hopes it causes Trump to lose the election but I don't think it's going to work. It's really the only chance they got, none of those pathetic candidates they have running has a chance in hell, this is their Hail Mary.

Not really. They've voted on impeachment, but impeachment is literally something upon which the Senate can act to remove (or not remove), IMHO.

They cannot just destroy his reputation like that making charges and not furthering it to trial for him to defend himself. That would deny him the right to be acquitted. They are evil

The house has to choose “managers” to deliver the case to the senate. Until that happens they have not completed their role in the impeachment process. Therefore they have not impeached him yet

The choosing of House Managers is a procedural task that is part of the Senate trial. Like Hank described, the impeachment vote is like securing an indictment from a grand jury. It still has to be served for the case to move forward to trial.

I feel fine I'm not delusional, I know he will likely remain President for another 5 years.

Copied from CNN Political article:

Though the House adopted two articles of impeachment charging Trump with abuse of power and obstruction of congressional investigations, it must pass a second resolution formally naming impeachment managers to present the case in the Senate. That second vehicle triggers the official transmission of articles to the Senate.
