So the Westfall Act is going to be important for Fauci going forward

Generally, it offers immunity from personal liability for torts committed by federal officers acting within the course and scope of their employment.

The AG must certify the officer was within this course and scope.

Can you see the Pandora’s Box opened for Noem and others if Fauci is denied Westfall Act protection?

I think it was the Carroll case if I remember correctly.

It’s certainly discretionary for the AG. It’s also subject to court review.

Dumb question, but can I also get a quick summary of his crimes?

- I know there was flirting with GOF, but I always felt like Baric and I think Daszak were more involved.

- With masks and jabs, even if pointless, he will say he erred on the side of caution.

- He's a scumbag liar, but I don't understand the "crimes against humanity" angle.

Yes. However, if it’s proven he knew about the lab leak and continued to lie to the President and other elected officials saying it was a wet market while not disclosing that he was involved with the specific lab, then the Westfall Act should not cover him.

It covers people acting in good faith. There’s certainly evidence that wasn’t the case for him.

There’s going to be a Beria, “show me the man and I’ll show you the crime” angle to this.

Florida AG has already taken the political opening it’s created.

But Westfall clearly fits here for any advice he gave regarding the pandemic and he should be provided counsel for whatever indictments are rendered.

There’s a lot to unpack here. I’ve read some of the diary entries early on suggesting he thought it was more lab leak than others he was on calls with.

But even then, is not everything he’s doing and learning within his course and scope as a federal official?

And more importantly, did his scientific opinions and recommendations differ whether he thought lab leak or wet market? There’s a ton of nuance there.

And is Trump going to waive executive privilege to go after him? That lets Fauci introduce notes and testimony about Trump’s deliberative process, too.

Neither do I.

I do not like Anthony Fauci, but mostly because I see him as an incompetent academic who was in over his head for the entirety of the pandemic. What's more, he was the worst kind of incompetent: arrogant, egotistical, and borderline narcissistic. However, that does not make him a criminal.

Here is the problem, he himself knew that the virus was probably man made (not to mention he helped fund the creation of it). Then he used a smear campaign to discredit anyone that did not obey. He also told the public to do things that he privately disagreed with causing harm and sometimes death. There is much more than what I have shown in this post but you get the point. His diary and emails are a death sentence if the auto pen is negated. States can prosecute him easily from the info I have looked at so far. In short, that bitch is fricked one way or another.

I get this from a political and PR perspective.

From a legal perspective, it’s much, much more complex. There’s discretionary immunity, whether he had the authority to order anything (versus Trump following his advice and ordering it), and a complex timeline of who knew what and when.

He’s an easy scapegoat because the diaries are such off putting navel-gazing , but that doesn’t meant he’ll be convicted of a crime.

You’ll have a tough time proving mens rea and proximate cause. And even then, likely so.

Was he personally or professionally invested in the wuhan lab?

If so, what did he know and when did he know it?
I don’t have anything bookmarked to share here bc I haven’t been on the board lately (stopped keep receipts :lol) but there have been hints he continued to say it was wet market after he knew or should have known it was from the lab.

The amount of lies an obfuscation whether or not rises to the level of criminal activity will yet to be seen…. But it’s quite extensive.

1.) Vaccine safe
2.) Vaccine effective
3.) Mortality rate
4.) Canvassing for nominations for self enrichment
5.) Lab leak “theory”
6.) … ++

There’s an overall trend of attempting to deceive the public and administration.

Articulate that further versus passive advice from Fauci versus the independent clinical judgment of the treating physicians versus the individual comorbidities of the decedent.
