Small Business Owner: Just got hit with my first big job loss

As I’ve posted before I’m a small business owner in the construction field.
My developer just pulled on a 1+ million dollar residential development in SELA that I’m GC for. We are 70% complete. Scheduled to pour streets Monday and he shut down the job.

Reason given: He’s afraid if our sub’s employees get sick, they might sue him for continuing a job when there is a statewide suggestion of shelter in place. Could be a cover to salvage money, but he’s already neck deep into the development, so I can’t imagine the bank is breathing down his neck to stop.

This is the kind of shite that these "we need to take as much precaution as possible" assholes never factor in.

frick all those people that support a full shut down over this nonsense.

Maybe his lawyers got a letter from the insurance company saying "shut it down"?

It's also why we're not going to just "bounce back" to where we were before like some on this board falsely believe. The damage will be done.

Not near your job loss but.....a good friend of mine sold his biggest job ever.....they called Tuesday and put it on hold. He had a jobsite closed down because a young plumber claimed he had the virus. Turned out he was lying.

With as litigation-happy as we are, the developer has no choice. There is almost 100% certainty that if someone got sick both you and he would get sued.

This subject is a whole other pandora's box that really hasn't been opened yet.

Our company has been struggling with the same questions as your developer.

Well OSHA put out guidance that if you contract the virus while performing your normal working duties it’s considered a recordable illness. And that’s not from Facebook, I went to OSHA.gov and verified it. It’s there, as plain as day in the COVID section.

Which is fricking stupid by the way. But it exposes employers to lawsuits and workman’s comp claims.

I am a very small company and I had to cancel an event next Saturday that cost me 20K in sales that would have resulted in 12K in my pocket.


Its not something i can get back later. Just gone for this year.

Recording workplace exposures to COVID-19

OSHA recordkeeping requirements at 29 CFR Part 1904 mandate covered employers record certain work-related injuries and illnesses on their OSHA 300 log.

COVID-19 can be a recordable illness if a worker is infected as a result of performing their work-related duties. However, employers are only responsible for recording cases of COVID-19 if all of the following are met:

The case is a confirmed case of COVID-19 (see CDC information on persons under investigation and presumptive positive and laboratory-confirmed cases of COVID-19);
The case is work-related, as defined by 29 CFR 1904.5; and
The case involves one or more of the general recording criteria set forth in 29 CFR 1904.7 (e.g. medical treatment beyond first-aid, days away from work).

Not really any choice then. As ann employer, you have to shut down the job site.

How are you/anyone going to prove when and where you were infected? Seems like a good question one might ask...

Yep. Especially given that there’s no way to definitively tell where they were infected.

It’s crazy how we took a bad situation and turned it into a catastrophe. Our enemies must be laughing their butts off.

Was on a $1000 a day job on Monday that got canceled. Luckily it’s my only account that has been stopped and I was able to work on other things.

No one felt/thought this way last year when it was "just the flu".
