Should Martial Law be declared?

My understanding is that these lockdown orders are only constitutional if performed under a martial law declaration. Is that a correct assumption?

If so, should Trump evoke martial law?

you're calling it martial law. The US Constitution calls it suspending The Privilege of the Writ of Habeas Corpus. In my mind martial law is far more extensive and unconstitutional than suspending habeas corpus.

Trump should declare Martial Law. He should arrest all the dem leaders and throw them in prison along with the liberal SCOTUS justices. Elections will be postponed until the virus and deep state have been eliminated.

Everyone is down voting, but I think missing the point. I don’t think martial law should be declared but don’t think stay at home orders, or shelter at home, are constitutional outside of that declaration.

So, is it worth it under be circumstances?

An analogy is that it’s perfectly constitutional to say the N word. Government cannot arrest me for it unless it arises to a level that is a danger (falsely screaming fire in crowded theater).

The government can constitutionally make everyone stay at home via martial law. I don’t think they can without that declaration.

So, should they or quit tinkering with unconstitutional shelter at home articles.

Right now most people are voluntarily complying with a few exceptions and not challenging the authorities. I think for a President to get away with something as drastic as martial law , he would do well to go before Congress and demonstrate need like violent resistance and civil unrest. It would be entirely appropriate to seek the OK from his Cabinet and Congressional leadership
