America abided by this when it was a real country, and a country genuinely worth fighting for. Before it became a borderless, lawless land of freakazoid perverts and degenerate scum.

I used to laugh at that goofball Ayatollah in Iran when he called America the 'Great Satan.' Damned if he didn't turn out to be right in the long run.

It has to be at some level, if for nothing else, providing a baseline in property division in divorces. Also important when dealing with paternity by virtue of marriage. Without establishing parameters of what is legally a marriage, it would cause a lot of issues with that. And with a divorce rate sitting at 50%, it affects a lot of people.

And that doesn’t even address the multitude of issues that go along with being legally married like social security, pension beneficiaries, dying intestate, insurance, etc.

You want to completely remove marriage from the mean old law books, you’re not going to like all the other inherent consequences for that. This is a modern society, it’s necessary.

Not enough of them to tilt the meter. I’m a divorce attorney. Gay marriage has been protected since what 2012. I’ve had exactly two gay divorce cases (I practice in Nashville metro). Most gay marriages are short term (they have an extremely high divorce rate) and most of the time kids aren’t involved. So they’re pretty easy to get done quickly. Sure there are outliers but there aren’t enough gay people, then gay people who get married, then gay people who get divorced to make a big difference in a divorce attorney’s bottom line. Not in my state at least.

TBH, I’ve had more cases where one of the spouses comes out of the closet than a gay couple getting divorced.

Gays also generally go to gay attorneys for their divorces. Pee Wee Herman’s sister is actually a divorce attorney here and a big gay rights activist. (She’s a lesbian). She’s also not good at her job and cheap AF

Why are they doing this? Because they are worried that Obergefell will be overturned?

If Obergefell is overturned, then the “constitutional protection” will be vacated, which means that the matter returns TO THE STATES.

If the SCOTUS overturns Obergefell, then they would certainly overturn this new law on the basis of the 10th Amendment.
