Yeah, seeing as this recent Moslem convert was convicted and sentenced to death over 20 years ago, and waited 10 days prior to execution to raise this issue, I can see how the court considered it a BS appeal.
The key element in this case seems to be that the State changed its policy and precluded ALL religious “advisors” from all future execution chambers immediately after the clear lack of comstitutionality was brought to its attention.
The STATED basis for the decision (delay in filing appeal) seems weak. He filed apparently within a few days of denial of his request to have the imam present.
Yes, the original procedure was constitutionally problematic. The procedure was repealed. Arguably, the Court should have condemned the former procedure, but I won’t lose sleep over its failure to do so.

Most people don’t read those. I would have read it based on the article due to the obvious one-sidedness of the article. If the reasonable right is made to look racist, sexist, homophobic, or any other kind of mean and intolerant, there is likely more to the story than is being told.
