She lamented Roe because it brought a halt to the natural expansion of abortion rights/access that was taking place in the USA at the time and turned it into a hot button political issue that would dominate the Court for decades. Rather than let the political process play out, the Court interposed itself and poured gasoline on the issue via a very poorly crafted and terribly reasoned decision.

Now, a reasonable and constitutionally valid reversal of Roe (and Casey) stands to completely unravel this nation (because if the Dems do pack the Court and/or force a nationwide abortion rights law - you very well could see Civil War 2 - Electric Boogaloo).

Imagine if the Court had NOT issued Roe. We are almost 50 years later. It is likely that most states would have legalized abortion to some extent without the national rancor.

The country was much more conservative when Roe passed and there was no civil war. There won’t be one, either, if a right to abortion law passes. It would not be a terrible outcome, either. If a national law passes it will be a compromise on the order of abortion being legal in the first trimester, allowable in the second trimester for rape or serious health of the mother issues, and in the third trimester only to save the mother’s life.

That’s what we’ll end up with, on average, if we let the states decide, only we’ll have some in which nothing is allowed and some in which everything is allowed.

Since we're talking a SC justice here I'd just like to point out a fact that many people probably don't know - out of the seven justices who voted in favor of RvW five of them were appointed by a Republican president. Eisenhower appointed Brennan and Stewart, Nixon appointed Blackmun, Powell and Burger.

Republican presidents have a pretty bad record with SCOTUS nominees. The problem is that Dems shifted to absolute ideologues under Clinton and haven't looked back while GOP have continued to look for impartial jurists (with mixed success at best [for every Scalia, Thomas, snd Alito there's a Kennedy, Souter or Roberts]).

most people don't KNOW that....they THINK that. Even the good evidence hasn't reached the majority of Americans.

We never really had a first civil war, unless you count the revolution against Britain.

States tried to legally secede. Lincoln started a war to stop them. This is different than a true civil war.

Not only was she right, she was prescient. The political process should have been allowed to play out. Dems want the political process to solve things when it favors them, but want the Courts to give them what they cannot gain at the ballot box. That may be changing since they cracked the whole "voting" code in 2020. We'll see.

No it doesnt

The number of people that have super strong feelings about abortion one way or the other is pretty small

The economy and crime are much bigger issues to the majority

Like most things, forcing the issue is never the best course.

I agree that abortion would've been legal in most states, although with restrictions.

I agree with the last point.

However, my statement wasn't as to the decision itself (assuming the Left is not successful in their intimidation efforts), but as to what the Dems will likely do in response:

Jettison the filibuster
Pack the SCOTUS
Force through a nation-wide abortion law (that would be deemed constitutional by the packed Court)
