Except he didn't make the allegedly defamatory statements in any litigation. He purposefully steered clear of the craziness in pleadings.

The statements Dominion complain about were made on Twatter and other socials so will be hard to argue SLAPP

It is really really hard to win a defamation suit and the defendant can pry into almost anything they want to (professional or personal). It’s very invasive and still hard to win.

The assertion is the DC anti slapp statute doesn’t apply here and the remedy would be a motion to dismiss under rule 12 or a motion for summary judgement under rule 56. It’s not my assertion, but the holding of several federal circuit courts.

I still see this as part of the academic side and the 30,000-foot view to boot. When I speak of practical I am talking about things like how particular judges administer cases in specific jurisdictions. Taking the temperature of the court is a big part of the battle.

The quality of work Clare does is outstanding and while I have yet to read the Rudy complaint the one he filed against Sidney was excellent. You can see the BigLaw thoroughness and also the crafty nature of a boutique shop.

Unlikely. They want to defend their reputation. Despite what many here think, they aren’t activists for democrats. They have to sell their services to Dems and republicans. I don’t think they advance their cause by going directly after Trump. I could be wrong though.
