re-trial? This was a default judgment. It is an extremely aggressive approach by the judge.
When there is an order to preserve and you do not, it's called spoliation and there is an entire legal doctrine with multiple cases discussing the obligations of the party with evidence and available sanctions for failure to produce. This was the highest sanction and the court describes why in the order

For your feeble mind, Rudy was ordered by the court to preserve the evidence he had so it could be produced. Rudy did not preserve the evidence as required (meaning he had no evidence) . As a punishment for his flagrant violation of the order, the judge defaulted him as to liability which means he is 100 percent at fault as sanction.
If he had any evidence he was required to give it to the other party . He did not.
not exactly
the FBI took the electronic evidence, then gave it back
Team Rudy needed to scan the devices and analyze the meta data before they handed them over
rudy wanted Trump to pay for it, they stalled rudy
eventually they gave rudy the money, but the delay caused Rudy to miss deadlines
realizing the insurmountable mountain in front of them and the deck being stacked, Team Rudy said frick it and declined the judge’s orders

Did they allow him to present anything?
A firm contracted by Donald Trump's presidential campaign in November 2020 to investigate claims of voter fraud has been subpoenaed by the special counsel investigating those claims, the founder of the firm told ABC News.
Ken Block, the founder of Simpatico Software Systems, said he was subpoenaed to turn over documents related to his work with the Trump campaign.
The firm was the second one hired by the campaign that reported it found no widespread evidence of voter fraud.
"There were just crazy claims of fraud coming in from the most unlikely places, and some from very likely places that I was asked to evaluate carefully and was able to document and prove that every one of them was false," Block said, noting he completed his work in early December.

It is a pretty aggressive sanction given the facts. You should know that. I’ve been in court too, dude.

Choosing not to contest her claim is not the same as "admitting he lied." It's just not the place he chose to fight it.
Are you going to believe dem lawyers, or your lying eyes.

That isn’t what happened at all, Hank. Admitting making the statements is not admitting they were faso statements. Good Lord.

Wow... are you an alter of moment? Do you follow his/its unbelievably stupid posting in every single thread? I'm sure he is happy you are protecting him/it.
Is my analysis wrong?
I guess you are not tired of all the flamers that just post crap on here.

You usually send your discovery responses to the judge? He responded to a motion to compel and the judge just dismissed his arguments and issued a default judgement. The judge could have denied his arguments and ordered production. The judge was VERY aggressive with this ruling. You should know that.

Seems like he had a number of options other than thumbing his nose at the judge and opposing counsel.

I'm not looking at the docket but did Rudy file any motions for extension of time? Any writ of certiorari for the order that would deny that?
I assume not which are pleading errors that lead to this. As a lawyer he should know better

Sounds like Rudy went to the Trump school of choosing defense attorneys
Posted on 8/30/23 at 1:56 pm to AggieHank86
Who is financing the opposing council. As this is a civil suit, the FBI/DOJ should not be proactively assisting the two poll workers. Did not Rudy have the chance at discovering/examining/costing the two poll workers. This is all so confusing. I wish a competent legal mind such as Wednesday could explain.
