You can't claim self defense if you are in commission of a crime. But I don't think that will apply because it was a technical crime. A child can use a gun in self defense in the home and kill the intruder. That's self defense all day long.

Nope. Can add lessers before it heads to jury. They aren’t “new” they are lessers.

Essentially that’s why the prosecution was desperate to get that pic in. If they can get the jury to believe Kyle was the aggressor by raising his weapon, it wipes out self defense in every instance. So even though he takes a skateboard to the head or has a gun pointed at him, he can’t legally claim self defense. Their problem is that no one testified to Kyle ever being aggressive or threatening. The state also didn’t bring up Ziminski to testify that Kyle raised his weapon at him, which if he did you’d think you’d want him in court testifying to that fact

I have never watched a trial but I caught a fair amount of this one. My impression of the judicial system is not good. It seems like justice takes a back seat to egos, money and complicated rules. How an average person gets justice, I am not sure.

Maybe you get him for something like a reckless discharge,but that is about it.
What you need to be on the lookout for is the US Attorney if this case ends in not guilty across the board. Something tells me there will be a federal civil rights violation coming.

That's bullshite. Doesn't a defense attorney base his whole defense and arguments on the charges in front of him? How can you add a bunch of crap in at the last minute that the defense may or may not have addressed based on original charges? This will wrap the jury around the axle if allowed.

This is ONE of the most shocking things I learned during my watch of the trial the past 2 days.
Didn't spend any time previously watching videos - just what was shown on newscasts. Never did I sense more than one shot fired - and I don't remember any news source reporting it. must have ignored the multiple shots as being all part of the background noise.
The most SERIOUS thing I learned is that there was ZERO evidence available to warrant an indictment for anything other than some bullshite misdemeanor. = breaking curfew along with another 200000 unindicted thugs.
State and County and City and DAoffice and individuals all up and down the line need to be sued into bankrupt disgrace for this. Along with liars in the media and all politicians who maliciously distorted the issue for political capital.

How would you get him on reckless discharge thigh? He didn’t fire off dozens of rounds. He fired 8 in total 6 of which hit the intended target. His only missed were the two at jump kick man. He was very precise and not spraying and praying
