Rittenhouse Charges..and lessers coming

Lessers are coming on the three homicide charges (not others). As long as the lesser doesn’t require additional facts than current charges ..they can add lessers which give jury more options (generally just less time in jail).

The instructions to the jury on what the variations are will be huge. Intentional vs unintentional, reckless versus not, self defense, etc.

2nd degree vs 1st degree -they don’t believe they can show Kyle acted without disregard for human life is main difference.

I didn't think prosecutors could add charges like that after the trial began.

Honestly, this makes the DA look like a sore loser. Kyle is NOT guilty. Video shows it.

I asked this question before and never really got an answer. Let's take the shooting of the pedo. He fired 4 shots in 3/4 of a second. How is he supposed to look around and make sure no one else is in danger? Also, if there is someone around that may be in danger is he supposed to not shoot and let the aggressor kill him?

Every one of those charges would be bogus.

The kid fired his weapon ONLY when he was in danger from the three people he shot.

Anything other than not guilty regarding the shootings will be a travesty.

Lesser charges shouldn't be allowed past a certain point in the trial imo. Waiting until the last day to file them is chickenshit. "Since we can't kill the dog then we'll cut off one of his legs just to inflict some pain to make him uncomfortable".

Question for criminal lawyers: Procedurally, it would seem that lesser included charges would have to be identified and asserted prior to the defense moving for a directed verdict. Is the defense required to wait until after those charges are identified and locked in before making a motion? (If not, seems you'd have a better chance at a directed verdict before the initial charges are reduced.) Just curious.

Every charge and every lesser gets addressed independently.

The jury could have 8-10 charges to review and have to understand the burden on all of them …then look at the evidence.

I'm confused as to how one could put up an affirmative defense (if one wanted to) for a charge that didn't exist.

The facts would be different for each of the charges.

Yes. The whole video is compelling. Its clear as day Kyle was defending himself, but the media has been LYING (not shocked).

Doesn't a reckless misdemeanor mean he can't use self defense as an excuse? I thought I read somewhere that there's a lesser charge that could f him over

But how does a defendant get to defend himself against said charges when filed at the last minute?
