If there is no registry, how will they even enforce private sales? They don’t know who owns guns at the moment. They won’t know when they change hands. A registry and confiscation is the end game.

There are a ton of issues with universal background checks. Mainly because the 4473 references the transaction as a transfer. So any transfer would require a 4473. So borrow, loaning, handing a firearm would require a 4473.

Want you dad to keep your hunting rifle while you are at college? 4473 to put it in their paperwork and another one when you use it. Every time. Inherited a firearm? Paperwork. A shop charges 25.00 per firearm and you inherited your family firearms, let’s say 30 total. 750.00 for you to get them. Or you can’t get them because any older than 25 years are no longer on the books and you can’t prove ownership. So now they go to the government to be destroyed.

Oh and with the way 4473s are now you de facto registered everything so now that yearly tax gets to hit too.

I won't register anything. I sold all of mine to some guy named Jim Beam in a Walmart parking lot, all completely legal. I suspect we might see an "assault weapons" ban at some point in the near future though.

Because THEY didn't say they caused cancer, EVEN THOUGH EVERYINE KNEW THEY DID, that was the basis for STATE AGs (using plaintiff's attorneys) to sue their asses.

No gun manufacturer has ever claimed that the intended use of their product will not result in serious injury or death of someone.

Yes they did, and it's a point worth considering. Let me say first of all that I opposed giving money to people who got sick from smoking cigarettes. They knew the risks, they smoked anyway.

But to your point, I'd say that cigarettes serve no useful function in society other than personal pleasure. And again, if you want to smoke fine, but you shouldn't expect others to pay for your pleasure.

Guns, otoh, have many functions useful to individuals and society, such as hunting, self-protection, home protection, the defense of our nation, and law enforcement. We need guns in the hands of a wide range of people in order for an even wider range of people to live optimal lives. We don't need cigarettes to do so.

We just got through with that exact episode, having the ATF on the precipice of making hundreds of thousands felons, simply by declaring a previously unregulated form of weapon illegal. So, by fiat, unelected bureaucrats decide whether you’re a felon. See the problem?

There ARE background checks that have been in place for a long time.

Any person who wants to purchase a firearm LEGALLY must do so from a FFL(Federal Firearms License) holder.

The FFL seller MUST require the purchaser to fill out an ATF 4473 Form.

*The purchaser MUST present a valid government issued photo ID(hmm, one must have an ID to purchase a firearm BUT not to vote).

*The purchaser must list their current address, place of birth, and SSN.

*Plus there is a check-list that the purchaser must fill out.

Also on the ATF 4473 Form is the make, model and serial number of the firearm that is purchased by the buyer.

**This does not apply to individual transactions, like someone passing a firearm onto an other family member, friend or two individuals conducting a private exchange/sale.

**Some states are NOW requiring these type transactions must done through a FFL holder(California, New Jersey, Nevada, Colorado...)

Once all the requirements are met on the 4473 form, the seller runs this through to the FBIs
NICS(National Instant Criminal Background Check System).

If the 'background' check comes back clean, the person is allowed to purchase the said firearm.

***THIS IS A FEDERAL BACKGROUND CHECK***


Now, here is a HUGE kicker. The selling FFL MUST retain all NICS records for 20 years. Those that are rejected, the seller must keep those records on file for 5 years.

Now this is ultimate kick in the balls to our freedoms.

The ATF can request these records ANY TIME they deem necessary.

So in reality, there is a national firearm registry in place that the federal government has on EACH and EVERY legal firearm sell that has/is done through a licensed FFL.
