One simple question about claiming asylum....

The "caravan" is heading to Mexico City. There is a US embassy there (and between where you left and where you are going a total of 11 US embassies and consulates) where you can claim asylum, and Mexico has already agreed to help you if you stay in Mexico.
Instead you decide to travel several hundred more miles to the Cali border.....and claim asylum. Why would any and I mean any of these not be summarily dismissed immediately as bogus, and tell them to walk back across the border, no free plane ride back home for stupidity.

You don't get to walk through multiple other countries to do it anywhere on the border.
It has to be at the point of entry of the nearest able country.
How do we know that Mexico and the other Central American countries are able countries? Well because the progresses ensured all of us that these were not shitholecountries, but were first world-leading first class Nations.

Exactly - Then they should all be summarily deported - and the deportation should consist of a flat bed 3/4 ton truck dragging a large trailer making round trips across the border until all are on the Mexico side - with assurances of felony convictions with maximum sentences, if they reenter after deportation.

They could have requested in Guatemala city, where they already passed.

To your "simple question," one cannot file for asylum at a US embassy. The statute and regulations do not allow it. Asylum is about non-refoulment, not immigration.
Why would these claims be "summarily dismissed" under the law? Point to a section in the asylum statute or regulations that would call for or even allow for this summary dismissal.
I am not arguing for asylum to be granted to the "caravan." The vast majority will not qualify for asylum.
Most individuals who are granted asylum entered the United States with a visa. These visas were issued at consulates. If there were a process to file for asylum at a US consulate, don't you think people would do so?
The "law and order" party should be in favor of hearing the claims under the law and remove those who do not qualify. What do you think happens to those who are turned around at the land border and not sent home? They just keep trying to get across.

I'm all for the free mandated plane ride because otherwise they'll fan out into the countryside only crossing the border illegally anyway.

I agree that this caravan needs to be stopped, but regardless what you’ve heard on the news, you CANNOT claim asylum at embassies or consulates. You must physically be in the US, which is why they must get to a point of entry.
As for the other, we do not require you to seek asylum at your nearest safe country, just that we strongly urge that.
Again, just clearing up facts set forth by the USCIS.

Skipper, here is why they should be sent back across the border....
The ruling surprised many because the EU's advocate general had recommended otherwise, but it should not have, because it is founded on something called the "Dublin Regulation" which embeds the premise of seeking asylum in the first point of entry into EU law. The Dublin regulation itself, though, is merely the EU's codification of an already established principle of international law that is reflected in the United Nations Convention and Protocol Relating to the Status of Refugees.
Last I checked we were part of the UN....
You are right, they cant file for asylum at our embassies or consulates, they can and should have at Guatemala and Mexico.

Wait a minute? The conservative argument here is that the US should defer to the UN and "international law" instead of it's own sovereign procedures concerning who it lets apply for asylum?

They would be.
So remind me why anyone is triggered about this caravan? The whole thing is stupid.
