Not certain this is the correct board but I have a question about the Karmelo Anthony case

He has been charged with 1st degree murder. Can he be convicted only on that charge or can the jury or judge convict him of a lesser charge ?

It would be a shame, imo, if he skates entirely on that sort of techicality.

Even if he skates, and assuming he has no conscience to haunt him, he will only get worse. And end up in the courtroom again, or morgue. Of course OJ handled it pretty well.

It would really be interesting and informative to see and feel what people like this experience right after they exit the body and face Truth. Both the Light and the Dark. Knowing that would change the whole Humanity dynamic. Maybe it will.

Even the defense witnesses said on cross examination that Anthony instigated the incident, that he was in the wrong, and that there was no reason to bring a knife to the track meet.

I’ll be surprised if the verdict comes back with anything but guilty.

This happened in Collin County and what you said might have been true 30 years ago but not so much now. There are still plenty of people with that attitude but it only takes one juror to swing the verdict. I’m not saying he’ll be found not guilty but the sentencing will leave you disappointed.

Same thing happened to the guys who beat Reginald Denny during the 1992 L.A. riots. One of them went on to murder someone and went to prison and another was murdered in his early 30s.

With the overwhelming evidence and his age 17 at the time of the crime his defense should be looking for a settlement.

Maybe 25-life, he could possibly get out in 15-20 years with good behavior.

The death penalty doesn’t apply to 17 yr olds in Texas even though they are considered adults in the court system

This assumes the DA is offering a deal.


The guy and his side have acted like such shitheads while there was such a strong case against them that the prosecutor may have decided there wasn’t a point in dealing.

You clearly don't take into account the demographics, or judges, of the major metro areas in Texas.

Because the murderer was 17 at the time, potential penalty is only from 15 to 99 years in prison

Texas does not have degrees of murder per se.

Capital murder has 2 penalties on conviction, death and life without parole. As Karmelo was not 18 (month shy) at the time he can’t be charged with this.

Murder - 5-99 year sentence, parole is available. Not sure on percentage of time served.

Manslaughter - 5-20 is what I’ve seen posted on guidelines there.

Those are the conviction options, will depend on the judge instructions to the jury on what they can render a verdict for.

Yes. And it's not a just and fair world, but in a just and fair world, the jury will convict and the judge pass a more harsh sentence when evidence proves racial motivations elevating the "aggravated murder" accusations.

It was without a doubt racially-motivated aggravated murder. If this were in a blue state, Anthony would skate and be lauded as a hero. As it is, even with Texas not quite being "Texas" any more (particularly the major population centers), there's still a strong possibility that justice is served here.
