Also said the act is caught clearly on video. Only thing I could surmise right off hand is perhaps she hadn't actually thrown or attempted to throw the thing. Maybe was just getting it ready with what would have been the obvious target(s) in view.

Feds took over prosecution of the matter. State of New York's out. Charged with illegal use of incendiary devices with law enforcement officer kicker.....up to 20 years on the sentence. Upgrading or adding or amending charges is not out of the question. But I cynical about that possibility.
