When the framers wrote the Constitution they never envisioned the Supreme Court to become as powerful as it has.

Seriously, they were pretty naive. They assumed judges would always actually attempt to interpret the Constitution as written rather than just make up rulings out of thin air.

They probably assumed Congress would impeach problematic judges much more often than they do, which is basically never.

Activist judges are supposed to be removed, that's their check/balance but they never are.

If life expectancy mattered to framers then why did Washington nominate 2 of the first justices who were already over that age?

Well they buckled. But of course, they didn't.

Jefferson was the first one to say frick you, you do what I say...but in doing that, you were seen as a dictator...while non-elected people suddenly became dictator over certain issues.

It became a Catch-22.

The "independance" of the SC became a gold standard in the 19th and early 20th century...away from politics and appointments and issues.

And it's all been a facade for most often...as FDR wanted to pack the court to pass legislation to stave off the Great Depression because the court was full of justices against his philosophy and were not his appointees.

There is no true independance, everyone is beholden.

That said, I would be open to say a 14 year term limit for judges.


Also, let's apply this logic to Social Security. That money pool wasn't set up to be drained by people into their 80s and 90s. It's going broke and the onset of benefits needs to be adjusted back at a minimum.

John Marshall was 79 when he died while serving on the Court. His successor, Roger B. Taney, was still on the Bench when he died at 87 in 1864.

Dear Originalists,

Their point is not wrong, but their point is also irrelevant. Regardless of the “original intent” of the Founders, the “text” says what it says, and that “text” should be “strictly construed.”
