Mulvaney said,”No one wants a government shutdown it is not a desired end, but when a president vetoes a bill that’s put in front of him on a spending package, sometimes that has the effect of shutting the government down. We don’t go into this trying to shut the government down.”
When asked about Trump using emergency powers to build a wall, Mulvaney said, “It’s still better to get it through legislation. That right way to do it. But at the end of the day, the president is going to secure the border one way or another.”

Prediction, Trump will shutdown government again and declare a NE with funding well in excess of $5.7 billion. Then he will tell Dems to send him a bill with the $5.7 requested and he will cancel the NE & open the government. It seems clear that Trump doesn't want to issue a NE.

If there is an immediate ruling and a restraining order on something deemed a national emergency it won't end up at the SCOTUS until after 2020? Or are you saying the court will uphold the ruling, given that you say not a single slat will go up before then?

There are currently 32 active national emergencies. Trump has already declared 2 of them. What's the big deal? Here is a good summary of all the past national emergencies.
