Louisiana Health Care workers mandate

I'm an RN in Louisiana. Our CEO has held out until this week for court clarifications but has announced it. First dose or one dose clot shot mandatory by December 6th. Apparently Senile Joe and the Hoe's mandate deadline approaches and they have no choice or else will lose Medicare/Medicaid funding. Looking for any help with refusal/ exemption forms. I see that the religious one will be easily denied. I understand that they will not fire us but will not allow us to work and basically make us quit. A local cardiologist told a family member of mine to make them fire you and that is your only legal recourse.

Don’t quit, that’s for sure. Maybe you should request your employer pay for a full in depth physical exam for you (above and beyond the normal annual wellness stuff) prior to making a “decision” on the vaccine?

I'm really impressed with the work around Ron DeSantis is coming up with for this in Florida.

DeSantis is seeking to get rid of OSHA for Florida and replace it with a state agency controlled by Florida and by extension, its Governor.

That's the kind of forward out of the box thinking that makes him the best potential GOP candidate for 2024.

OSHA and CMS mandates are different — CMS mandates stop federal health dollars to facilities.

Hoping something works out soon.

Thankfully we are able to get religious exemptions. They are approved with ease.

I can tell you I have a contract with my employer — under that contract I work in a ltc facility.

The facility told me to file an exemption with my employer and if she accepts it, the facility will accept it.

If I request a medical exemption and my employer accepts it, the facility will investigate to make sure it meets the guidelines.

Basically they’re telling me that they know they can’t mess with or question a religious exemption.

File a religious exemption. You are protected by title 7 civil rights act. They must approve. If they deny, ask for reasonings in ink, on paper then threaten with a EEOC complaint. They will change their mind.

I have sauces in several companies that are the people who are approving or denying, one is in healthcare even. Can’t hurt to file it and make it look good. One of my sauces says his philosophy is who am I to say they don’t truly believe this.

Just don’t use a form letter that a local Baton Rouge pastor is handing out. That will get rejected real quick.

I’ll be interested to see how that goes.

For reference, a family member of mine works in our state air/water regulator (loves the job, for some strange reason). Long story short, the things you think the EPA do, they actually do, and have better standards for water than EPA.

Point being, I don’t think OSHA will be able to enforce shite. Everything will be on state regulators and company self-policing.

I'm asking for an immediate raise if they enforce it. If they give me the raise I'm going to ask for a signed letter saying that they're legally liable for any side effects it may cause since I'm only getting it for them. If I'm forced to get something for work then they're on the hook for the mandate financially and want to make sure that I have some income if it goes bad I'm not paying for all those myocarditis checkups on my dime when us youngins are at risk for it post jab

Yep and CMS can stop or delay funding while this all plays out which would bankrupt hospitals and any healthcare practice that takes medicare, medicaid, or Obamacare insurance plans. Just another example of how once you take the government’s money you become their bitch.

File both medical and religious exemptions. When you file religious, make sure you do not state your religion. Not only is it none of their business, but they can poke holes in your religious exemption if they know what you “practice”.

Get your PCP to write a medical exemption. In my experience, I have been successful with medical exemptions proving natural immunity with an antibody test. I have also been successful with cardiac history and/or family history and pulling the VAERS data for proof of side effects (like I said, mostly cardiac and hematologic).

I know it’s stressful. I’m sorry you’re put in this position. It may be difficult to find a provider to sign your medical exemption. I have tried to help as many people as possible by writing exemptions. It’s our right to refuse. Also remember that they cannot afford to lose you. Literally, the hospital can’t. They will likely approve all exemptions, especially if your employer has waited this long to implement something. They are ONLY implementing because of CMS and Medicaid/Medicare, that means they do not want to implement this mandate because they KNOW they cannot afford to lose nurses/hospital staff. This means, they will accept all exemptions. The institution I work for implemented the mandate first in the area and they have not refused an exemption yet. They cannot afford to. Patient care has already tanked in the hospital because of SNAP nurses. There is a reason Mississippi and Texas kicked SNAP nurses out of the entire state.

Stand up for what you believe in. You are doing the right thing. I’ll be happy to answer any questions you have. I do not know everything but I have been writing exemptions for patients for months. I have only had issues with one company and they are not medial.

DeSantis should tell Biden to go frick himself. The Federal Govt will absolutely not withhold funding for Medicare/Medicaid. All these shite stains care about is optics. Withholding funds does not pass the optics test.
