No. It’s a waste of time.

This is very similar to the brooks shooting. The taser would be considered non lethal but it is what comes next that gives the reasonable fear

Both the taser and pepper spray incapacitate the victim leading the victim to fear for worse. This is just the case of two dumbasses meeting and getting dumbass actions.

It’s going to be tough to argue that deadly force was the only option for the shooter
You are on the right path, but read that statute again
quote:

Deadly physical force may be used only if a person reasonably believes a lesser degree of force is inadequate
the case will not turn upon objective facts seen in hindsight, but rather upon whether the shooter’s interpretation was reasonable based upon what was known to him at the time.

Like the Airsoft hypo

He experiences the following in rapid succession (fractions of a second)

1. He confronts a guy that he (arguably) thinks is a threat to the job he was hired to do, without drawing his weapon.

2. Said guy strikes him on the head, so he starts to draw his weapon. POSSIBLY he sees that said guy has SOMETHING in his other hand.

3. POP/BANG! Something explodes a few feet from him. He interprets it as an attack and fires his weapon in response to that threat.

That is how I would sell it to a jury, based upon the limited info now available. Details might change as facts develop.

Here is the Pinkerton Security Guard on his LinkedIn account.

Great job steering his client away from an incident as it was unfolding in front of him. A true professional.

Ill add this: if you own a business, are married and have a reasonable life dont go to these protests. Such a tragedy this had to happen.

Wrong.

The incident was occurring well in front of him. He turns and moves his client to a position where he can safely perform his duties.

This is 100% correct he had no business confronting anyone his job was to protect, how do you protect someone, and not commit murder.

And that is how the prosecution will try to sell the same set of facts.

Question for the board: What was on the victim’s shirt? It appeared to be BLM, but may have also included an anti-BLM message. I can’t make it out.

There will be no selling. If he is a licensed (or equivalent) security professional in the state of Colorado his training record (or lack thereof) is going to become a matter of public record. And he is going to be eviscerated.

Just a cursory review of the video show multiple tactical errors by him (client in front of and to his dominant hand which is creating a potential flagging situation, poor situational awareness of the unfolding confrontation, letting him go to the narrow/constricted part of the confrontation in front of him to the right, not steering him into the open, safer area to his left, becoming a part of the confrontation, not de-escalating et al).

He is looking at prison. Period.

This part I disagree with. He is there to secure a client whose job is to cover the demonstrations. Conflict is a part of it. Position your client to safely cover it. Just the briefest of tactical assessments would have led him to move his client to the left to where he is not hemmed in and where he still can cover what is occurring.

What is not seen (but I believe will eventually come out - speculation on my part) is Dolloff went directly to the victim and verbally confronted him and the victim responded with a push (think of the personal foul flag in football, you always catch the second guy). That is when both drew their protective measures (mace versus a pistol).

I agree with your outline on the defense’s approach. I don’t know if it will be successful, but I suppose that mostly depends on the jury.

Can you imagine if law stated that you could use deadly force against mace at these protests? There would be a trail of bodies.

Every wannabe Billy Baddass on both sides would flock to the protests just begging to get maced, so they could off some political opponents.

Darwin Awards to all present. Society wins.

Agreed. There was plenty of space to maneuver to the left and record (as several were doing) the confrontation. But I don’t think that was the intent of the “Pinkerton Security Guard” as he approached. Like our MSM, he made himself part of the story.
