The idea of gender is over. No more discussions of women’s issues since women are merely an idea and not a real thing from the courts perspective.

Yes, there was a throwaway line to that effect in the intro to the first draft of the opinion. It was a stupid mis-cite.

Not sure how a careless reference has any bearing upon whether this judge is a stupid true believer or a disingenuous politico.

Reading the opinion reads like a bit from Animal Farm. “Gender is a deeply held internal sense of being a man or woman.” There’s no legal analysis. It’s just “Here’s what your overlords are telling you. Now suck it.”

My question is, some of these FTM trans people look and dress like men. They have beards even.

Making them go to the bathroom with women is a problem.

I don't know about Hank (I haven't posted here that long) but that absolutely describes a large chunk of the judiciary these days. This decision came down to "legal analysis" about as much as Obergefell.

Obergerfell was a bit flowery, but I never Understood how accepting traditional religious definitions of marriage isn’t an establishment of religion When a lot of religions now accept gay marriage.

Scalia warned us. They'll continue to create laws that are in line with their personal political beliefs until they're held accountable.

I never cease to be amazed by the number of folks who cannot grasp the difference between the Constitutional limits as to what government CANNOT do and the political/legislative decisions as to what government SHOULD do.

teenagers are no better... in fact this would make it ripe for sexual assault cases and ruin a lot of kids lives for nothing. This ruling is beyond asinine in every aspect of the word.

Holy crap, man, did you skip civics class? No, it's not what everyone does, it's what duly elected legislatures do, or in this case (and this was a rule, not a law) it's what the school board elected by their community to perform this function do. And they answer to the voters, who can remove them from office for unsatisfactory performance.

Judges answer to no one and their job isn't to create laws.
