I would be more in agreement with the latter than the former, but it is pure sophistry to pretend that a coherent (if erroneous) analysis does not underlie it.
But more substantively, and more closely-related to the post to which I responded, our system does not provide impeachment as a remedy for weak legal analysis.

He asked whether you believe the opinion was written in good faith (i.e., not with a political goal in mind).
If you feign ignorance, then you have your head up your arse and/or you are viewing this through a political lens, and I would never trust your legal advice.

I have no clue as to which description would fit this judge, but many Obama-types DID tend to be “true believers.”. I would call it a coin-flip.

It was earlier posted that this judge confused the Constitution with the Declaration of Independence in a previous ruling, but you are still willing to give this judge the benefit of the doubt.
