Not so fast.
It would seem he is now open for contempt of court ruling by DC Circuit for failure to comply with their original order.

Appropriate since he appears to have nothing but contempt for the court.

Yeah, Sullivan’s got nothing to hide.

I hope the appeals court censures him and begins disbarment proceedings. Contempt.

So the Federal Judge who brought on outside counsel/ ex federal judge to essentially prosecute the case has now hired a lawyer to defend his actions/inactions in handling the case. He’s basically subbed out the entire criminal process. Our tax dollars at work for this insanity.

The good news is the DNC now has less money to campaign with.

What a shite show our justice system has become. Burn it all down!

This typically happens when you appoint people due to their skin color rather than their actual experience and achievements.

I feel extremely sad for competent black folks because they'll always be judged by the actions of this idiot judge and all the other post turtle AA appointments and hires.

So, if he can’t handle a case himself and he can’t defend himself to his superiors...

He's turning the criminal justice system and legal system entirely on its head and is breaching the separation of powers.

Sullivan is essentially saying water is dry, upside is down, 2+2=5 and the sky is green.

If we allow judges to hire lawyers to represent themselves to judges that outrank them to argue over litigation where both parties have come to an agreement to dismiss the case, we will be opening up a can of worms.

The DC circuit should rule against Sullivan hiring the lawyer.

Admittedly, I am scratching my head on this one. In ordinary mandamus proceedings, you sue the public official in their official capacity (as opposed to their personal/individual capacity) to compel them to perform a ministerial duty (one that they have no discretion to refuse performing), such as the issuance of a license or cancellation of liens, etc.... In those types of proceedings, the public official or board is entitled to legal representation.

A mandamus against a judge to explain his/her reasoning is something more akin to a demand for the court to issue written reasons for judgment. So I agree this is different and weird.

Sullivan is treating the request by the DC Court as an indictment and therefore his defense team will be handling the answers from now on.

If he doesn’t comply by the deadline, the DC court dismisses the Flynn case and moves on. They aren’t obligated to entertain anything other than what they order and within that timeframe.

The D.C. Circuit should just grant the motion to dismiss.
